1. Scope
These General Terms and Conditions of Business and Use apply to use of the Billardshop platform at shop-billiard.com.
The platform is operated by zekahub IT-Dienstleistungen, zekahub.de. Further information about the operator is provided in the legal notice.
Billardshop is designed as a platform for product listings, seller profiles and direct communication between users. The platform operator provides the technical environment through which sellers can offer products and prospective buyers can contact sellers.
The platform operator does not provide a conventional checkout, payment processing, shipping processing or purchase processing unless expressly stated otherwise.
2. User account and registration
Users may create a customer account. Information provided during registration must be correct, complete and up to date. Login credentials must be treated confidentially and must not be disclosed to third parties.
The user is responsible for protecting the account against unauthorised access. If misuse or unauthorised use is suspected, the user should inform the operator without delay.
The operator may reject registration or restrict a user account where there are objective reasons, in particular false information, misuse, security risks or breaches of these terms.
3. Customer role, seller role and seller profile
Registered users can use the platform as customers and contact sellers.
A registered user may apply to become active as a seller. Once approved, the user receives a seller profile and can create and manage their own product listings.
The operator may reject, restrict or revoke approval as a seller where there are objective reasons. These include in particular misuse, suspicious reports, false information, breaches of these terms or legal risks.
In Billardshop, new product listings must be assigned to a seller profile. Administrators who list products themselves also require a seller profile for this purpose.
4. Product listings, variants and images
Sellers are responsible for the accuracy, completeness, currency and lawfulness of their product listings.
Product names, descriptions, prices, brand information, condition information, variants, images and other content must be truthful and must not infringe third-party rights.
Sellers may offer only products that they are legally permitted to offer. In particular, unlawful, misleading, fraudulent, insulting, discriminatory, harmful-to-minors, copyright-infringing or trademark-infringing content, as well as counterfeits, is prohibited.
By uploading images or text, the seller confirms that they hold the required rights and that the content may be displayed on the platform.
The operator may hide, block or delete product listings, images, variants or other content if these terms, applicable law or legitimate interests of other users or the operator are violated.
5. Direct communication and contracts between users
Prospective buyers can contact sellers using the chat function. Communication is intended to coordinate details concerning the product, condition, price, payment, collection, shipping or other matters.
A purchase agreement is concluded exclusively between buyer and seller if they reach an agreement. The platform operator does not become a party to the purchase agreement between buyer and seller.
The operator assumes no responsibility for the conclusion, performance, payment, delivery, collection, warranty, withdrawal or other obligations arising from an agreement between buyer and seller.
Buyers and sellers are responsible for complying with legal obligations. Commercial sellers must in particular observe their own statutory information duties, consumer rights, legal-notice duties, warranty obligations, tax obligations and other legal requirements.
6. Use of chat
The chat may be used only for factual communication related to products and sales.
Prohibited conduct includes in particular spam, fraud, phishing, threats, insults, discriminatory content, unlawful content, advertising unrelated to the listing and attempts to circumvent platform security mechanisms.
The operator may restrict chat functions or block users in the event of misuse or a breach of these terms.
7. Reporting listings and moderation
Logged-in users can report suspicious or inappropriate listings using the “Report listing” function. Reports are treated confidentially. The reported seller is not automatically informed which user submitted the report.
The operator reviews reports at its discretion and may in particular decide:
- no violation,
- block the listing,
- block the seller.
If a listing is blocked, it is no longer displayed in the public shop. If a seller is blocked, their products are no longer displayed in the public shop.
Blocked sellers may not create new listings or edit, delete or upload existing listings, variants or images. The data is not automatically deleted but remains stored so that the moderation decision can be traced.
Admin and moderation areas may continue to display blocked content so that reports, decisions and internal notes can be reviewed in a traceable manner.
8. User obligations
Users undertake to use the platform lawfully and considerately.
In particular, it is prohibited to:
- provide false or misleading information,
- infringe third-party rights,
- post unlawful or fraudulent content,
- conduct spam, automated mass requests or scraping,
- circumvent security mechanisms,
- use accounts, chats or product listings for unlawful purposes.
9. Availability and technical changes
The operator endeavours to keep the platform stable but does not owe uninterrupted availability.
Maintenance, updates, security measures, technical disruptions or force majeure may temporarily restrict use.
The operator may change, extend, restrict or discontinue functions where necessary for security, further development, operation, prevention of misuse or legal requirements.
10. Blocking, restriction and deletion
The operator may remove content, hide product listings, restrict functions, block seller profiles or suspend user accounts if these terms, applicable law or legitimate interests of other users or the operator are violated.
In the event of serious or repeated violations, the user account may be permanently suspended.
Statutory retention obligations and legitimate documentation interests remain unaffected.
11. Liability
The operator is liable without limitation for intent and gross negligence, injury to life, body or health and under mandatory statutory provisions.
In the case of ordinary negligence, the operator is liable only for breach of material contractual obligations. In this case, liability is limited to foreseeable damage typical for the contract to the extent permitted by law.
The operator assumes no liability for contracts, arrangements, payments, deliveries, collections, product condition or other dealings between buyers and sellers unless the operator itself is a contracting party.
The platform operator merely provides the technical means for users to contact each other. The operator does not verify users' solvency, ability to deliver, identity, reliability or contractual compliance and does not guarantee that a product is actually available, paid for, delivered, collected or handed over free from defects.
12. Changes to these terms
The operator may amend these terms where required by legal, technical or functional changes.
Users will be informed of material changes in an appropriate manner. Where consent is required, it will be obtained separately.
13. Consumer dispute resolution
The operator is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.
14. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer-protection provisions provide otherwise.
If any provision of these terms is or becomes invalid, the validity of the remaining provisions remains unaffected.
